These Terms of Use govern your access to and use of aurexrising.com, operated by Aurexrising, LLC. By using the site you agree to these terms. If you do not agree, please do not use the site.

1. Independent publisher — no carrier affiliation

Aurexrising, LLC is an independent affiliate publisher. We are not a wireless carrier, reseller, dealer, or authorized agent, and we are not affiliated with, endorsed by, or sponsored by US Mobile, UnlockBase, or any wireless network operator. All trademarks belong to their owners and are used only for identification and comparison.

2. Affiliate disclosure (FTC 16 CFR Part 255)

This site contains affiliate links. If you sign up or purchase through them, we may earn a commission at no additional cost to you. Our recommendations reflect our honest, independent opinion and are not determined by commission rates. Material connections are disclosed clearly and conspicuously near the links themselves.

10. Limitation of liability

To the maximum extent permitted by applicable law, Aurexrising, LLC, its owner, members, and contractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost savings, profits, goodwill, or data, arising from or related to your use of the site, any affiliate link, any third-party product or service, or reliance on any content, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages.

Aggregate cap. Our total aggregate liability for all claims relating to the site will not exceed the greater of (a) the total amount you paid us, if any, in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).

Some states do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited, or rights you have under applicable consumer protection law.

11. Assumption of risk and release

You use this site and act on its information at your own risk, including any decision to switch carriers, port a number, purchase a plan or device, or unlock a device. Device unlocking and carrier switching may affect warranties, financing agreements, promotional credits, or existing service. Verify eligibility and consequences with your current provider first. To the fullest extent permitted by law, you release Aurexrising, LLC from claims arising out of disputes with any third-party provider.

12. Indemnification

You agree to defend, indemnify, and hold harmless Aurexrising, LLC and its owner, members, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the site, your violation of these terms, your violation of any law, or your dealings with any third-party provider.

13. Dispute resolution, arbitration, and class-action waiver

Please read this section carefully — it affects your legal rights. First, contact us at support@aurexrising.com and give us 30 days to resolve the issue informally.

If we cannot resolve it, you and Aurexrising, LLC agree that any dispute arising out of or relating to the site or these terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property misuse. The Federal Arbitration Act governs this section.

Class-action waiver. Disputes will be brought only in an individual capacity. You and we waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action, to the extent permitted by law. If this waiver is held unenforceable as to a particular claim, that claim will proceed in court and the rest of this section still applies.

30-day opt-out. You may opt out of arbitration by emailing support@aurexrising.com with your name and the words “arbitration opt-out” within 30 days of first using the site. Opting out does not affect any other part of these terms.

14. Time limit on claims

Any claim relating to the site must be filed within one (1) year after the claim arose, except where a longer period is required by law. Otherwise, the claim is permanently barred.

15. User submissions and DMCA

If you send us messages, chat inputs, or feedback, you grant us a non-exclusive, royalty-free license to use it to operate and improve the site, and you confirm it does not violate anyone’s rights. If you believe content here infringes your copyright, email support@aurexrising.com with a DMCA notice identifying the work, the URL, your contact details, and a good-faith statement. We remove infringing material promptly.

16. Accessibility

We aim to keep this site usable and accessible, working toward WCAG 2.2 AA guidance. If you encounter a barrier, email support@aurexrising.com and we will work to fix it or provide the information another way.

17. Changes to these terms

We may update these terms. The revised version will be posted here with a new “Last updated” date, and continued use of the site means you accept the update.

18. Governing law and venue

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where the mandatory consumer laws of your home state apply. For any dispute not subject to arbitration, the exclusive venue is the state or federal courts located in California, and you consent to personal jurisdiction there.

19. Force majeure, severability, and entire agreement

We are not liable for delays or failures caused by events beyond our reasonable control. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms, together with our Privacy Policy, are the entire agreement between you and Aurexrising, LLC regarding the site, and may not be assigned by you without our consent.
